Privacy Policy

This is the Privacy Policy (“Policy”) of Kidhood Technologies OPC Pvt Ltd, a company incorporated under the Companies Act, [1956/2013], and having its registered office at #92/42, 2nd Cross, Raghavanagar NTY Layout Bangalore 26 (hereinafter referred to as “Company”) and is applicable to the parent/guardian (“you”) on behalf of your child (“child”) who is using the Application (defined below).

 

Thank you for downloading Company’s application ’GenBlend’ (which includes any products or services offered therein) (“Application”). We value the trust you place in us. This Policy discloses Company’s information practices for this Application including the type of information being collected, method of such information collection, and use of such information and sharing of such information with third parties.

 

By visiting the Application you expressly consent to our use of your personal information in any manner described in this Policy. This Policy extends to registered users who download, register and use the Application.

 

  1. Your Personal Information

    1. By accepting this Policy, you authorize the Company to collect and store and use any information that you may enter on our Application or provide to us in some other way.

    1. You must register for an account on behalf of the child. To enable you to become a registered user of our Application and to stay updated on all matters in connection with the Application, you will have to provide certain basic personal information like your first and last name, email address, age, and mobile number.

    2. As indicated in the Terms of Service, in order to use the Application, You must provide your financial information including but not limited to, bank account details, credit card, debit card, or any other payment details to subscribe to the Application, following the 7 (seven) day trial period.

 

  1. Child’s information

    1. To present the appropriate activities to the child on the Application, we will need you to provide your child’s basic personal information including their age and gender.

 

  1. We assure you that at no time will this information be sold or shared with parties not associated with us.

 

2.How We Use the Information We Collect

2.1.Company owns all the information collected via the Application.

 

2.2.Your information. We may use the information described above to:

2.2.1.Verify your identity as the parent/guardian or the child on behalf of whom you seek to register an account on the Application.

2.2.2.Create and manage your account.

2.2.3.Send you (via email or other means) offerings of products or services and update you on all the special offers available on the Application to ensure a better experience for you. You can unsubscribe from such communications anytime you wish to do so.

2.2.4.Monitor and improve the Application including by calculating the number of visitors to the Application, identifying the geographical locations of the visitors and their demographics, preferences, interests, and behaviour. We may share such Application usage statistics with our sponsors, advertisers or other third parties (which do not include Company marketing partners and network providers).

2.2.5.Communicate with you about, and administer your participation in, special events, contests, offers, surveys and market research.

2.2.6.Respond to your queries.

2.2.7.Operate, evaluate and improve our business.

2.2.8.Besides the above, this information may be used when you contact Company through any means such as chat or email. Company reserves the right to include your email ID for marketing communications.

 

2.3.Child’s information. We may use the information described above to:

2.3.1.Present the appropriate activities on the Application to the child.

2.3.2.To customize, adapt, and personalize the content-consumption and viewing experience; for example, by measuring the child’s performance in activities and adapting the child’s learning experience to the child’s learning needs.

2.3.3.To analyze, provide progress reports on, or provide an assessment of the child’s performance to you.

 

2.4.Both you and your child’s information. We may use the information described above to:

2.4.1.To allow us to assess and improve the Application, its content, and other services we provide (for example, to improve our content and user experience); to research, evaluate, and improve the educational efficacy of the Application; and to inform our understanding of the user base of the Application.

2.4.2.To maintain and analyze the functioning of the Application.

2.4.3.To maintain, and monitor, the activities on the Application in our sole discretion to avoid any violations of this Policy, our terms of service, or any applicable law.

2.4.4.As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to detect violations of and enforce our terms of service; (e) to protect our operations; (f) to protect our rights, privacy, safety, or property; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

 

3.Reasonable Security Practice & Procedure and Reasonable Exceptions

3.1.The Company has reasonable security practices and procedures to protect your and your child’s personal information against any unauthorized access, use, alteration, disclosure or destruction. These include encryption, and password protection of your and your child’s data to which only authorized personnel of the Company shall have access. All the information collected through the Application is securely stored within the Company’s controlled database. The Company’s security and privacy policies are periodically reviewed and enhanced as necessary and only authorized individuals have access to the information provided.

 

3.2.However, as effective as the Company’s security measures are, no security system is impenetrable. Therefore, no guarantee or assurances whatsoever can be given to the security of the database, nor can the Company guarantee that information you supply in relation to yourself or your child, will not be intercepted while being transmitted to the Company over the internet. Accordingly, the Company earnestly request you that in case you do not want the risk, please do not use the Application.

 

4.IP Address

  1. When you visit our Application, Company collects your IP address to help diagnose problems with its server, administer and tune the operation of its Application, analyze trends, track traffic patterns, gather demographic information for aggregate use, and track the date and duration of each session within our Application and similar purposes. Your IP address may also be used in combination with your personal information to prevent fraud or abuse, customize your experience on our Application, improve our Application, customer service, products, and promotional efforts, and to understand your preferences, patterns and interests.

 

5.Cookies and Web Beacons

  1. Company collects data through cookies and other monitoring technologies to enhance your experience on our Application. ‘Cookies’ are small pieces of information that are stored by your browser on your computer’s hard drive to collect information about your activities on our Application. We may authorize third parties to use cookies and other monitoring technologies to compile information about the use of the Application or interaction with advertisements that appear on the Application. We do not have access or control over these cookies. We do not link the information we store in cookies to any personally identifiable information you submit while on the Application. 6.Sharing of Information

  1. Any personal information, if collected, will be passed on to our trusted Partners and service providers who shall need access to the information upon your placing an order with us. We use trusted third-party service providers to perform certain services on our behalf, including for the purposes of payment processing, data storage/management, web hosting, web analytics, fulfillment, marketing, mailing, emailing, and delivery of products/services. These Partners and service providers only receive personal information if such information is needed to perform their function(s), and they are not authorized to use any personal information for any other purpose(s) other than the purpose(s) set forth by Company.

7.1.Upon request, we will remove your and/or your child’s personal information from our database. We may require access to your personal information in order to provide you with services and such removal of your personal information from our database may make you ineligible to avail services. You may at any point access and correct any erroneous information about you or your child directly on the Application.

 

7.2.You have the right to ask us not to process your or your child’s personal data for marketing purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. You can also exercise the right at any time by contacting us at the e-mail address in clause 14.1 below. 

 

7.3.The Application may, from time to time, contain links to and from the Applications of our partner networks, advertisers and affiliates. If you or your child follows a link to any of these Applications, please note that these Applications have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these Applications.

 

8.Business Transfer

  1. Your personal information may be disclosed as part of any merger, sale of Company’s assets or acquisition, as well as in the event of insolvency, bankruptcy or receivership.

 

9.Comments

  1. We value your comments, feedback, and testimonials which help us improve our Application, products, and services. By making such submissions to us, you assign your rights in the submissions to us.

 

10.Children’s Privacy

  1. Our Application is directed to be use by children, i.e., individuals under the age of 18, and we only collect the following personal information from children for the purposes set out in this Policy, i.e., age and gender, after prior consent from the parent/guardian. You agree and acknowledge that the child’s input of personal information and usage of the Application shall, at all times, be under your supervision.

 

11.Phishing

  1. Safeguarding information to help protect you from identity theft is a top priority and we at Company take all measures to protect identity theft. We do not and will not, at any time, request your credit card information or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.

 

12.Links

  1. This Application may contain links and advertisements which may lead you to other Applications. Please note that once you leave our Application you will be subjected to the privacy policy of the other Application and this Policy will no longer apply. By using this Application, you signify your agreement to the terms of this Policy. Company reserves the right, in our sole discretion, to change, modify, and or delete portions of the terms of this Policy at any time.

 

  1. Limit of Liability

    1. Notwithstanding anything to the contrary in this Policy or any other terms of service or use applicable as between Company and you, Company’s aggregate liability hereunder towards direct damages shall be limited to Rs.1000 only. Company’s liability shall not extend to any indirect or remote damages whatsoever, including but not limited to special, incidental, consequential, or punitive damages or loss of profits.

  1. Applicability of Policy

    1. While this Policy applies to all personal information collected, stored and used by Company, it is intended to comply only with the applicable laws of India and not any other jurisdiction. All matters of dispute are subject to the courts in the city of Bangalore.

 

  1. Applicability of Terms of Service of Application

    1. This Policy is specifically designed for the Application which is made for children. This Policy shall at all times be read together with the terms of service of the Application, which outlines the appropriate use of the Application by the child and your responsibility in connection therewith. You hereby acknowledge that the Application shall strictly be used by the child as per the terms of service. By using the Application, you agree to abide by both the Policy and the terms of service. You shall remain responsible for supervising the child’s use of the Application at all times and ensuring that they follow the terms of service.

 

  1. Compliance

    1. Company shall always cooperate with regulatory authorities and investigating agencies in India in the matter of treatment of personal information.

 

  1. Severability

    1. In the event that any part of this Agreement shall be held by a court of competent jurisdiction to be unlawful or otherwise unenforceable, the remainder of this Agreement shall remain in full force and effect to the maximum extent possible, and an attempt shall be made to substitute the unenforceable provision with an enforceable provision of similar intent.

 

  1. Assignment

    1. Company may, at any time, assign this Agreement and/or its rights and obligations under this Agreement to any entity, in its sole discretion.

 

  1. Amendments

    1. Company may modify this Policy in its sole discretion at any time. While Company shall make best efforts to notify you of any such modification via email, it shall be your responsibility to read and understand the Policy as prevalent from time to time. Continued use of the Application shall be deemed to constitute acceptance of the Policy as amended.
